1. About these Terms

These Terms of Service (“Terms”) govern your access to and use of the coaching/education service provided via consulinsight.click (the “Service”). By accessing or using the Service, you agree to these Terms.

2. Eligibility and accounts

• You must comply with applicable laws and be able to form a legally binding contract.
• You are responsible for maintaining the confidentiality of any credentials and for all activities under your account.
• We may suspend or terminate your access if we reasonably believe you violated these Terms or used the Service improperly.

3. Acceptable use

You agree not to: (i) misuse the Service, (ii) attempt to gain unauthorized access, (iii) disrupt or interfere with the Service, (iv) violate intellectual property rights, (v) post or transmit unlawful, harmful, or deceptive content, or (vi) use the Service to provide services or materials that infringe third-party rights.

4. Coaching/education; no guaranteed results

The Service is for educational and coaching purposes. Results depend on your individual circumstances, effort, and decisions. We do not guarantee specific outcomes, performance, income, or business results. Any examples, statements, or testimonials on the Service are not guarantees and may not reflect typical results.

Important: To avoid misleading advertising, we provide the Service as-is and do not promise guaranteed outcomes. This statement supports compliance with Act on Specified Commercial Transactions (Act No. 57 of 1972) - Article 12 (Prohibition of Misleading Advertisement).

5. Service availability and changes

• We may modify, pause, or discontinue features of the Service at any time.
• We may update these Terms. Continued use after updates means you accept the revised Terms.

6. Limitation of liability

To the maximum extent permitted by applicable law, consuIinsight.click (including its officers, employees, and affiliates) will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service.

Our total liability for any claim related to the Service will not exceed the amounts you paid to us in connection with the Service during the three (3) months immediately preceding the event giving rise to the claim.

7. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Intellectual property

All content, materials, trademarks, and other intellectual property included in the Service are owned by us or our licensors. You may not reproduce, distribute, publicly transmit, or create derivative works without prior written permission.

9. Payments, refunds, and purchases

If you purchase any paid service or program, pricing, payment timing, and refund conditions (if any) will be provided at or before purchase. Unless otherwise stated, subscriptions and access fees are non-refundable after delivery/access begins.

If the Service is used to advertise and accept purchases/contracting from consumers online, the following operator/advertising indication is provided in accordance with Act on Specified Commercial Transactions (Act No. 57 of 1972) - Article 11 (Indication of Advertisement) and Act on Specified Commercial Transactions (Act No. 57 of 1972) - Article 12 (Prohibition of Misleading Advertisement).

10. Termination

We may terminate or suspend your access if you breach these Terms or if we reasonably determine continued access is inappropriate. Upon termination, sections by their nature should survive, including disclaimers and limitations of liability.

11. Governing law

These Terms are governed by the laws of Japan. Any dispute will be subject to the jurisdiction of the competent courts in Japan.

12. Privacy and cookies (brief)

If we use cookies or similar identifiers that may be considered personal data/personal-related information under Japan’s APPI, we will provide appropriate transparency and seek required consent, and we will process personal information in accordance with the Act on the Protection of Personal Information (Act No. 57 of 2003) and the Personal Information Protection Commission (PPC) Guidelines/FAQs on APPI and related interpretation (as published on PPC website).
